Ways to Protect Assets
There are a variety options that can help people with disabilities safeguard their assets. To help you compare these options, we’ve included a downloadable chart outlining the key differences and benefits of each.
Supplemental Needs Trusts
Supplemental, or “Special”, Needs Trusts (SNTs) are a type of trust designed to help individuals with disabilities protect assets that exceed government “means-tested” benefit (i.e., Medicaid or SSI) asset limits.
In these types of trusts, the Beneficiary is the individual with the disability. The reason why this works is that funds in the SNT technically belong to the SNT, but the Beneficiary can still use the funds in the account to make life-enhancing purchases by filling out a withdrawal request. It almost acts like a bank that pays a vendor for you.
There are three main types of Supplemental Needs Trusts: First- Party, Third-Party, and Pooled. Whichever one is best for you depends on your needs and preferences. You can also have multiple different types of SNTs simultaneously.
